These Terms of Service ("Terms") govern your access to and use of the Zaya mobile application and related services (collectively, the "Services") provided by SUPERMIND PTE. LTD ("we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years of age to use the Services. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Services with the consent of a parent or legal guardian who agrees to be bound by these Terms.

By using the Services, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

To access certain features, you may need to create an account using your email address, Apple Sign-In, or Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information and to update it as necessary. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Services

Zaya is an AI-powered astrology companion application that provides personalized astrological content, including natal chart analysis, daily insights, and conversational AI interactions based on your birth data (date, time, and place of birth).

The Services are for entertainment and informational purposes only. Astrological readings and AI-generated content do not constitute professional advice of any kind, including but not limited to medical, psychological, legal, or financial advice.

4. AI-Generated Content

The Services use artificial intelligence to generate content and responses. You acknowledge and agree that:

  • AI-generated content may not always be accurate, complete, or up to date.
  • You should not rely on AI-generated content for important decisions.
  • We do not guarantee the reliability, accuracy, or suitability of any AI-generated content.
  • AI responses are generated algorithmically and do not represent the opinions or advice of SUPERMIND PTE. LTD.

5. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law or regulation.
  • Infringe on the intellectual property or other rights of any third party.
  • Upload, transmit, or distribute harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable content.
  • Attempt to gain unauthorized access to the Services, other accounts, or any related systems or networks.
  • Use the Services to develop competing products or services.
  • Use automated means to access the Services without our express written permission.
  • Reverse engineer, decompile, or disassemble any aspect of the Services.
  • Interfere with or disrupt the integrity or performance of the Services.

We reserve the right to suspend or terminate your access if you violate these Terms.

6. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio, software, and the overall design, are the property of SUPERMIND PTE. LTD or its licensors and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes in accordance with these Terms.

7. User Content

You retain ownership of any content you submit through the Services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store such content solely for the purpose of providing and improving the Services.

You are solely responsible for the content you submit and represent that it does not violate any third-party rights or applicable laws.

8. Balance and Payments

Zaya works on a prepaid, pay-as-you-go basis — not a subscription. There are no recurring charges and no auto-renewal.

(a) Topping up. You can add funds to your in-app chat balance through in-app purchases via the Apple App Store or Google Play. Payments are collected by the respective app store and are subject to that store's payment terms.

(b) How your balance is used. Your balance is consumed as you use the Services — including chatting with Zaya and generating charts and readings — based on actual usage. The amount of usage a given balance provides depends on the underlying model and service configuration and may vary.

(c) Nature of the balance. Your balance is a prepaid right to use the Services. It is not money, stored value, or a deposit; it cannot be withdrawn, transferred to another account or person, or redeemed for cash. Balance shown in the app is denominated in U.S. dollars regardless of the currency you paid in.

(d) Expiration. We do not currently apply an expiration date to purchased balance. If we introduce one in the future, we will provide reasonable advance notice, and it will not apply to balance purchased before the change.

(e) Free and bonus balance. We may grant free or bonus balance (for example, to new users, beta participants, or through promotions). Free and bonus balance has no cash value, may be subject to additional conditions, and may be adjusted or withdrawn at our discretion.

(f) Refunds. Payments made through the Apple App Store or Google Play are subject to that store's refund policies, and refund requests must be submitted to the relevant store. Except where required by applicable law or the applicable store's policy, purchases are non-refundable once the balance has begun to be used.

(g) Pricing changes. We may change pack prices, bonus amounts, and consumption rates from time to time. Changes apply only to purchases and usage after they take effect and do not reduce balance already added to your account.

(h) Apple App Store. For the iOS app, your use is also governed by Apple's Licensed Application End User License Agreement (the "Standard EULA", https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). If these Terms conflict with the Standard EULA with respect to the iOS app, the Standard EULA controls to the extent of the conflict.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy or completeness of any astrological or AI-generated content.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUPERMIND PTE. LTD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR USD $50, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless SUPERMIND PTE. LTD and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Services or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. You may stop using the Services and delete your account at any time.

Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination will continue to apply.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Singapore, without regard to its conflict of laws principles.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Singapore.

14. Changes to These Terms

We may modify these Terms at any time. The updated version will be indicated by a revised "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SUPERMIND PTE. LTD regarding the Services and supersede all prior agreements.
